Terms + Conditions

Introduction

Welcome to Pat Nash Media. These Terms and Conditions ("Terms") govern your use of our photography and videography services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

Services

Pat Nash Media provides photography and videography services for weddings, events, brand content, and other creative projects. Our services include, but are not limited to, the capture of images and video footage, editing, and delivery of final products in digital or physical formats.

Booking and Payment

A non-refundable deposit is required to secure your booking. The balance of payment is due 30 days prior to the event or project start date. Failure to make payment by the due date may result in the termination or suspension of services. All prices are quoted in Australian dollars and are inclusive of GST unless otherwise stated.

Cancellation Policy

If you wish to cancel your booking, please notify us in writing.

  • If cancellation occurs 7 or more days before the event, 100% of the total amount paid will be refunded, excluding the non-refundable deposit.

  • If cancellation occurs within 7 days of the event, no refund will be provided.

Copyright and Usage

All images and video footage captured by Pat Nash Media remain the copyright of Pat Nash Media, in accordance with the Copyright Act 1968 (Cth). Copyright typically lasts for the life of the creator plus 70 years.

The client is granted a non-exclusive, non-transferable license to use delivered images and footage for personal, non-commercial purposes. Pat Nash Media retains the right to use images and footage for portfolio, promotional, and advertising purposes, unless otherwise agreed in writing.

Copyright in commissioned works will only transfer to the client where this has been explicitly agreed in writing. Pat Nash Media may exercise a right of restraint to prevent misuse of commissioned works.

Privacy and Data Protection

We respect your privacy and are committed to protecting your personal information. Any personal information collected through our contact forms or during the course of our services will be kept secure and confidential. We do not sell or share your personal information with third parties without your consent, except where required by law. For more details, please refer to our Privacy Policy.

Limitation of Liability

Pat Nash Media will take all reasonable care in the provision of our services. However, we shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of our services. In the event of unforeseen circumstances, such as equipment failure or acts of God, our liability will be limited to a refund of the amounts paid by the client.

Governing Law

These Terms are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Australia.

Changes to Terms

Pat Nash Media reserves the right to amend these Terms at any time without prior notice. Continued use of our services after any such changes constitutes acceptance of the new Terms.

Wedding Agreement

Wedding Photography & Videography Contract Agreement

1. Agreement Overview

1.1 This agreement is between Pat Nash Media (referred to as "Photographer," "Videographer," or "the Photography Company") and the Client.

1.2 This agreement constitutes a binding electronic contract between Pat Nash Media and the Client.

1.3 All payment terms and refund conditions are outlined in the Payments section of this agreement.

1.4 All visual content, logos, and other media created by Pat Nash Media are the Photographer's intellectual property and are protected by copyright law.

1.5 No warranties are provided regarding the final product beyond those expressly stated in this agreement.

1.6 The Client acknowledges that any links to external websites provided by the Photographer are for informational purposes only, and the Photographer is not responsible for their content or terms and conditions.

1.7 All disclaimers related to unpredictable factors, including weather, apply as outlined in Section 17.

2. Handling of Client Information

2.1 Client information is collected solely for the purpose of this agreement and any necessary communication related to the services. Information will be kept secure and will not be shared or sold to any third parties.

3. Age Appropriateness

3.1 All services and content provided are intended for individuals aged 18 years and older. The Photographer does not create or display content involving nudity, making all work suitable for general audiences.

4. Personal Information

4.1 Data collected includes names, contact information, and any relevant details needed to perform the service. This data is handled with strict confidentiality, and clients may request updates or corrections to their information at any time.

5. Cookies and Website Use

5.1 Our website uses cookies to enhance user experience and track website performance. By using the website, clients agree to the use of cookies.

6. Changes to This Agreement

6.1 The Photographer reserves the right to update this agreement, including the privacy terms above. Clients will be notified of any significant changes that affect how their data is handled or tracked.

7. Consultation

7.1 The parties agree to a pre-event consultation to finalize shooting times, locations, and the Client's request list for specific photographs.

8. Time Allocation & Requested Images

8.1 The couple agrees to allocate sufficient time for all requested pre-ceremony photographs — at least 30 minutes before the start of the wedding.

8.2 Allow approximately 3 minutes per requested individual or group photo as a general guide.

8.3 At least 30 minutes must also be allocated after the ceremony for photographs that could not be taken before or during the wedding.

8.4 The Photographer will not be held liable if late arrival of the couple or guests prevents all desired images from being taken.

9. Coverage, Availability, and Delivery of Images

9.1 The Photographer will provide coverage for the dates, locations, and hours specified in this agreement.

9.2 Additional travel or coverage hours may be added by agreement on the wedding day but must be paid in full before any photos or products are released to the Client.

9.3 The Photographer will make every reasonable effort to capture requested images but cannot guarantee all of them due to uncontrollable factors such as weather, light, time restrictions, and subject willingness.

9.4 The Photographer will use professional judgment and sole discretion to select which images to deliver, editing out substandard or duplicate images. This selection constitutes the final set of images made available to the Client.

9.5 Depending on the package, a USB and/or online gallery containing all edited photos will be delivered within 4–8 weeks of the event.

9.6 Depending on the package, video will be delivered via an online link (available for 30 days) and/or USB. All video is backed up for one year and available for download within 7 days of a requested re-upload; the re-upload link remains active for 7 days.

9.7 The Photographer is under no obligation to capture any specific moment, pose, or person during the shoot — for example, the bouquet toss. The Client is encouraged to provide a suggested photo list no less than 24 hours prior to the shoot; however, the Photographer has no liability for capturing any photo on that list.

10. Assignability and Parties of Interest

10.1 The Client understands that, unless otherwise specified in this agreement, they are not contracting for a personal service to be performed exclusively by one named photographer. The Photographer may sub-contract or assign a second shooter or associated photographer to fulfil the duties under this contract. All photographers assigned will be capable and competent to perform the services professionally.

11. Content Editing and Manipulation

11.1 Delivered files and/or proof sets may contain a mixture of colour, black and white, and selective colour images unless otherwise agreed before editing.

11.2 Limited colour correction and/or retouching is included at the Photographer's discretion.

11.3 All video projects are delivered as a first draft, with one round of revisions included. The Photographer aims to deliver an authentic representation of the day, capturing moments as they naturally unfold. Should any content be perceived as inappropriate or not aligned with the Client's preferences, it will be reviewed and adjusted as needed to meet reasonable expectations.

11.4 Further changes beyond the initial revision may be requested for an additional charge, varying based on complexity.

11.5 The Photographer is not responsible for prints not ordered directly through them, and recommends ordering through a reputable lab for best results.

12. Copyright and Image Use

12.1 As the creator of all images produced under this agreement, the Photographer retains copyright ownership. Under Australian Copyright Law, copyright in commissioned wedding photography would otherwise sit with the commissioning client; by entering this agreement, the Client agrees to transfer that copyright to the Photographer in exchange for ownership of the digital files and a non-expiring personal license to print, duplicate, and share their wedding images.

12.2 The Photographer may use images created under this agreement — without identifying the individuals or event — as samples of work for prospective clients, marketing, or competition entry.

12.3 The Photographer will seek the Client's written consent before publishing any images from their wedding in the public domain (e.g. website, blog, bridal media, social media).

12.4 The Client gives permission for the Photographer to use images in the private domain (e.g. in-person consultations, sample albums, educational purposes).

12.5 The Client may, at any time, request that any previously displayed image be taken down from public and/or private use.

13. Illness, Injury, and Unavoidable Events

13.1 In the event of fire, an act of God, illness, or injury affecting the Photographer, all reasonable efforts will be made to secure a suitable replacement to ensure the day is still captured. If no replacement can be secured, all fees will be refunded to the Client, with no further liability.

13.2 This limitation of liability also applies where photographic materials are lost or damaged without fault on the part of the Photographer.

13.3 The Client agrees to indemnify and hold the Photographer harmless for any liability, damage, or loss related to technological failure. Cameras, hard drives, and memory cards are subject to failure; the Photographer will take reasonable steps to prevent data loss but is not liable for loss due to technical failure.

13.4 The Photographer's liability is limited to the amount paid under this contract. It is acknowledged that a wedding cannot be re-enacted or replicated.

13.5 In the unlikely event of cancellation by the Photographer, a suitable replacement may be sought. If this is declined by the Client, the Client may terminate the agreement and receive a full refund of all monies paid within 7 business days.

13.6 The Client understands that the Photographer may have cords, light stands, and other equipment on location, and agrees to hold the Photographer harmless for any injury or damage caused by this equipment, or arising while posing or working with the Photographer.

14. Change of Date, Venue, and Cancellation

14.1 Upon signing, the Photographer reserves the agreed time and will not accept another booking for that period. For this reason, all deposits are non-refundable, even if the date is changed or the wedding is cancelled. Cancellations must be made in writing and sent directly to the Photographer.

14.2 A cooling-off period of two (2) business days applies from the date of signing and initial payment, for any change of mind. After this period, no refunds for change of mind will apply.

14.3 Should the event be cancelled, the Client agrees to notify the Photographer as soon as possible. The Photographer may, at their discretion, return some or all monies paid.

14.4 Where an event is cancelled within three (3) months of the wedding date, the Photographer may retain monies paid, reflecting other bookings declined as a result of the reservation.

15. Payments

15.1 Payments are accepted via cash, bank transfer, credit card, or cryptocurrency (where applicable).

15.2 A non-refundable deposit of $1,000 is required to secure the booking and date.

15.3 Payment plans are available for up to 12 months, with the final payment due at least 30 days before the event. The schedule will be outlined in the agreement.

15.4 Failure to complete final payment within this timeframe may result in cancellation of the booking, with no refund of the deposit.

15.5 All fees and taxes are included in the total price stated in the agreement.

16. Meals, OH&S, and Breaks

16.1 The Photographer (and any contractors) will not remove enclosed footwear for safety reasons, other than where a jumping castle requires this.

16.2 The Client agrees to arrange with their venue for seating where the Photographer (and contractors) may safely store equipment.

16.3 The Client agrees to provide the Photographer (and contractors) with a meal and dessert, ideally served alongside guests. If this cannot be accommodated, the Client will advise at least 30 days prior to the event so alternative arrangements can be made.

16.4 The Photographer (and contractors) may take short breaks as needed throughout the day.

17. Disclaimers

17.1 The Photographer is not liable for disruptions caused by weather, venue changes, or other factors outside their control on the day.

18. Severability

18.1 If any part of this agreement is found void, invalid, or unenforceable by a court of competent jurisdiction, that finding will not affect the remaining provisions, which will continue in effect.

19. Amendment and Waiver

19.1 This agreement may only be amended, modified, or waived by a written document specifically identifying this agreement and signed by both parties or their authorised representatives.

20. Headings and Subheadings

20.1 Clause headings are provided for reference only and do not form part of this agreement.
